In Italy, the issue of collective protection, although it has long been a topic of discussion among legal experts, has caught the attention again of scholars only in recent years, representing, due also to the evolution of the economic system, a need for effective protection of super-individual rights and interests. This paper analyses the theoretical-constitutional issues and the ways in which our legal system initially regulated collective actions (law 244/2007) and, subsequently, class action (law 99/2009 and later amendments), focusing on the recent choices made by the legislator (l. 31/2019) on this issue.
